HC directs Punjab Govt. to take decision on payment of salary for vacation period

The High Court has directed Punjab government to take a decision on demand of Guest Faculty Lecturers of Government Colleges for payment of salary for vacation periods, in terms of judgment of Supreme Court of India.
Justice Daya Chaudhary on Tuesday issued a direction to the Punjab Government to take a decision on the demand of Mukhveer Singh and 33 other Guest Faculty Lecturers working in various Government Colleges in the State, who had filed civil writ petition, seeking, inter-alia, salary for vacation periods between consecutive academic sessions.
They had stated that they have been used to be relived at the end of academic session, and then taken back on duty in the beginning of next academic session, thereby depriving them of salary for period of summer vacations.
The Counsel for petitioners brought it to the notice of the HC that recently in a similar case, decided on May 5, 2016, the HC had directed the State of Haryana to pay salary to Guest Faculty Lecturers for vacation period. He also referred to a judgment in Avtar Singh v. State of Punjab, decided on November 11, 2011, against which even SLP (Civil) filed by the State of Punjab has been dismissed by Supreme Court on 17.4.2015. The petitioners’ Counsel therefore, argued that they should be paid salary for summer vacation periods atleast from 17.4.2015 onwards. The HC thereupon directed the Punjab Government to take a decision on demand of petitioners within a period of three months, in the light of aforesaid judgments, and to release to them the amount of such salaries for vacation period falling after 17.4.2015 onwards, within further period of three months, if held entitled.
