Widowed, divorced daughters eligible for family pension: Govt

New Delhi: Widowed and divorced daughters of a deceased central government employee are eligible to get family pension, the government has said.    The Ministry of Personnel has recently issued a circular in this regard after it received a number of communications from other central government ministries and departments seeking clarifications.    Family pension is payable to the children as they are considered to be dependent on the government servant or pensioner or his or her spouse.     "A child who is not earning equal to or more than the sum of minimum family pension and dearness relief thereon is considered to be dependent on his or her parents.    "Therefore, only those children who are dependent and meet other conditions of eligibility for family pension at the time of death of the government servant or his or her spouse, whichever is later, are eligible for family pension," the rules said.    Similarly, family pension to a widowed or divorced daughter is payable provided she fulfills all eligibility conditions at the time of death or ineligibility of her parents and on the date her turn to receive family pension comes, they said.    According to the rules, the turn of unmarried children below 25 years of age comes after the death or remarriage of their mother or father, i.e., the pensioner and his or her spouse.    "Thereafter, the family pension is payable to the disabled children for life and then to the unmarried, widowed or divorced daughters above the age of 25 years," said the rule.    The provision of providing pension to widowed and divorced daughter of a pensioner existed earlier too.    Regarding opening of old cases, a daughter if eligible may be granted family pension with effect from August 30, 2004, according to the circular issued on Wednesday.

Government changes norm for widow pensioners


New Delhi: The government has done away with the requirement for widows to present themselves before two gazette officers to "verify" their status for getting family pension in certain cases.

The Ministry of Personnel, Public Grievances and Pensions has received representations from various quarters to do away with the condition of applying for family pension through 'Form 14' as it was causing inconvenience to widows, who find it difficult and "embarrassing" to present themselves before two gazetted officers or persons of repute for attestation.

"The matter has been examined and it has been agreed that in case the pensioner and spouse are holding a joint account, the possibility of claim for family pension from someone else does not arise. Therefore, in such cases, there is no requirement of Form 14.

"The spouse may inform the bank of death of the pensioner and request the bank for commencement of family pension, through a simple letter. He or she may enclose a copy of death certificate of pensioner, pension payment order, proof of his or her own age or date of birth and an undertaking for recovery of excess payment," the Ministry said in an order.

In other cases, like where pension is not being credited to the joint bank account of the pensioner and his or her spouse, Form 14 will be continued to be obtained by the banks.

"However, the condition of attestation of form 14 has been done away with and witnessing by two persons has been considered as sufficient," it said.

Before commencement of family pension, personal identification details of the spouse, such as specimen signature, mark of identification and left hand thumb impression, proof of age or date of birth of spouse and an undertaking from him or her for recovery of excess payment are to be obtained by the bank.

Form 14 serves as a standard processing sheet, which defines and delineates the exact requirement of information to be given to the pension disbursing bank.

There are about 30 lakh Central Government pensioners.

we can avail dual family pension but punjab govt still not issued order on the pattern of central government. we are also waiting for that order
