Govt could decide soon on moving SC on promotion quota

New Delhi: The government today informed the Lok Sabha that it would soon take a decision on whether to intervene in the Supreme Court on the issue providing reservation benefits to SCs, STs and OBCs in promotions.

Govt to decide on promotion quota scrapped by SC Days after Supreme Court quashed Uttar Pradesh government's decision on quota benefits to SCs, STs and OBCs in promotions, Government today said it will soon decide the future course of action as concern was voiced in Parliament over the issue. Significantly, BSP chief Mayawati, who returned to Rajya Sabha a few days back, was accorded a special privilege of raising the issue during the Question Hour which was accordingly delayed by about 10 minutes. The former Uttar Pradesh Chief Minister, in her debut speech during the current term, demanded that the Centre should bring a Constitutional amendment bill during the ongoing session of Parliament to provide for reservation to SC and ST government employees in promotions. The top Court last week quashed UP government's decision to provide reservation benefits for SCs, STs and OBCs in promotions saying the state failed to furnish sufficient valid data to justify the move to promote employees on caste basis. In the Lok Sabha, the issue was raised by Congress member P L Punia who said the Supreme Court verdict has '  "created certain confusion'   and wanted the government to seek a clarification from the apex court. He received support from several members in the House from various parties. Responding to the concerns, Minister of State in PMO V Narayanasamy said discussions were on between the Ministries of Law and Justice, and Social Justice and Empowerment and the government '  "will take immediate decision'   in the matter. He said the government, which had twice earlier brought amendments to the law, had referred the issue to the Law and Justice Ministry.

There should be no reservation in promotions as the general category suffers a lot.
It should only be based on overall seniority.

Govt. ne pehla v supreme court de 2 decision ise sambandh ch ulta dite san. Politicians ne vote dekhniya han islayi ho sakda hai is vaar v ohi howe jo pehla hunda aya hai.

There should be no reservation in promotions as the general category suffers a lot.
It should only be based on overall seniority. It should be given once in lifetime at the time of recurument or at the time of promotions, not at every step

PM calls all party meeting for SC/ST reservation in promotion


With quota politics hotting up, PrimeMinister Manmohan Singh has called an all-party meeting May 23 to discuss the way forward on giving reservations to the Scheduled Castes (SC) and the Scheduled Tribes (ST) in job promotions, an issue mired in controversy, sources said Friday.


The meeting comes in the wake of the recent Supreme Court ruling that quashed reservation benefits for the Scheduled Caste and Tribes employees in government job promotions given by the previous Bahujan Samaj Party (BSP) government in Uttar Pradesh headed by then chief minister Mayawati.
While the BSP has now demanded a constitutional amendment to provide quota in promotions for the SC and ST government employees, its mainpolitical rival Samajwadi Party (SP), which rules the state at present, wants the Other Backward Classes (OBCs) also to be included in this promotions quota benefit.
Members of parliament from the SC and ST communities had earlier this month met the prime minister and demanded the government should bring an amendment to the constitution or approach the apex court once again.
The issue assumes political significance as the presidential election is due in July and the government does not want to annoy either the Samajwadi Party or the BSP, whose support would be crucial to get the Congress nominee elected to the country's top-most post.

नई दिल्ली। सरकारी नौकरियों में अनुसूचित जाति (एससी) एवं अनुसूचित जनजाति (एसटी) के कर्मियों की पदोन्नति में आरक्षण देने के मसले पर रास्ता निकालने के तरीके पर बातचीत के लिए प्रधानमंत्री मनमोहन सिंह ने 23 मई को सर्वदलीय बैठक बुलाई है।

सर्वदलीय बैठक ऐसे समय में होने जा रही है जब सर्वोच्च न्यायालय ने अपने हाल ही के फैसले में सरकारी नौकरियों की पदोन्नति में अनुसूचित जाति एवं जनजाति के कर्मियों के लिए आरक्षण लाभ को निरस्त कर दिया है। सरकारी नौकरियों में पदोन्नति आरक्षण का लाभ उत्तर प्रदेश में पूर्व की बहुजन समाज पार्टी (बसपा) सरकार ने दिया था। न्यायालय के फैसले के बाद बसपा ने सरकारी नौकरियों में एससी एवं एसटी कर्मचारियों की पदोन्नति में आरक्षण देने के वास्ते संविधान में संशोधन करने की मांग की है। जबकि उत्तर प्रदेश में सत्तारूढ़ समाजवादी पार्टी (सपा) चाहती है कि पदोन्नति में आरक्षण का यह लाभ अन्य पिछड़ी जातियों (ओबीसी) को भी मिले।

गौरतलब है कि एससी एवं एसटी समुदायों के संसद सदस्य भी संविधान में संशोधन की मांग को लेकर कुछ दिनों पहले प्रधानमंत्री से मिले थे।
